Johnson & Johnson
Johnson & Johnson paid over $2 billion to settle lawsuits claiming it used talc in its Johnson’s Baby Powder or Shower to Shower body powder despite it knowing that ingredient had been proven to cause mesothelioma or ovarian cancer.
Wen Hair Products
Wen Hair Products settled a class-action lawsuit for $26 million regarding 1,500 complaints about WEN’s products causing hair loss and scalp irritation. Once the lawsuit action started it was discovered that WEN was hiding the fact that the company had received another 21,000 complaints about their product’s damages.
Hello Toothpaste
Hello Toothpaste paid $1.5 million to settle a Class Action Lawsuit that alleged Hello® falsely advertised and used the ingredient black “activated” charcoal in their toothpaste. Allegedly, the charcoal leads to enamel erosion.
Rodan + Fields
Rodan & Fields agreed to pay $38 million to resolve claims the company’s Lash Boost product contained a chemical that could cause harmful and serious side effects.
Huda Beauty
Huda Beauty agreed to pay a $2.8 million settlement with its customers to resolve claims its eye shadow contained ingredients that were unsafe to be near eyes.
Unilever
Unilever settled a claim against their Suave Professionals keratin lines for $10.2 million. According to the complainants, there was evidence that the company knew the ingredient DMDM hydantoin was dangerous and still used it anyway.
In March 2022, a class action lawsuit was filed in a New York federal court claiming that its incredibly popular waterproof mascara contains toxic substances. The ingredient in the spotlight is Polyfluoroalkyl Substances (PFAS). PFAs are synthetic chemicals that can cause damage to the liver and the immune system. They can even lead to reproductive issues.
Target was the named defendant in a class action lawsuit filed in July 2021 claiming that they misled customers by marketing products as “oil-free” on the packaging – yet, they contain oil including glycine soja sterols and dimethicone that are known carcinogens and can cause issues with the immune system as well as developmental and reproductive issues. Many people are known to have allergies to dimethicone – some quite severe.
This lawsuit did not proceed as the judge determined the individual didn’t have standing since they didn’t actually purchase the products.
Murad
A class action lawsuit filed against Murad, LLC claims that the company’s cosmetic products contain color additives that can be dangerous when used around the eyes. The lawsuit claims that Murad fails to warn consumers about this danger when informing them to use the products around the eye area. Specifically, the products are Retinol Youth Renewal Night Serum and Clarifying Oil-Free-Water Gel.
Almay
Almay markets its products to consumers as being clean and affordable, catching the eye of many consumers. However, they are another company that was slapped with a class action lawsuit concerning their use of PFAs.
Grande Cosmetics
In 2021, a class action lawsuit was filed against Grande Cosmetics for harmful ingredients found in their lash, eyebrow, and hair enhancement serums. The company claims that its products are safe to use without any dangerous ingredients and no side effects. Further research found the use of Isopropyl cloprostenate (ICP). The FDA states that these types of products with ICP are not safe unless used under the care of a licensed doctor.
Neutrogena
A class action lawsuit was filed against Neutrogena in 2021 regarding its Health Skin Cream with Broad Spectrum (SPF 15). This product contains benzophenone which is a known carcinogen and an endocrine disruptor. Of course, this is in addition to the trouble they were already facing due to another cancer-causing chemical, benzene, being found in their sunscreen.
Clinique faced several class action lawsuits in 2021. A couple of the most prominent is that it falsely marketed its products as oil-free when they weren’t and as claiming they contained live probiotics when they didn’t.
The truth? At least 8 of their so-called “oil-free” products actually contained oils, including dimethicone, tocopheryl acetate, and isostearyl neo pentanoate – which are known to cause unwanted side effects.
BareMinerals has found itself in hot water thanks to a 2021 class action lawsuit. The brand makes claims that they are clean and full of natural minerals and that they are rigorously safety tested, too. The lawsuit claims that their product range actually contains PFAs. And this goes against the trust they have built with consumers.
Maybelline
In 2020, Maybelline was the defendant in a class action lawsuit claiming that their “oil-free” products actually contained the oils tocopherol and hydrogenated polyisobutene.
